The Covid-19 pandemic has acutely affected the construction industry. The Government has intervened through legislation and various advisories from the relevant agencies. The undeniable impact on project delivery, associated costs and impact on revenue generation has affected all stakeholders. This can give rise to disputes if parties fail to compromise or resolve matters expeditiously. The effective preparation of and response to payment claims is particularly important given the constraints posed by Covid-19. To apprise project owners, consultants and contractors of the latest legal developments relating to the Security of Payment Act (“SOP Act”), this session will cover the following:
- Claims in 2020 and beyond – what are the new norms? Tips for effective case preparation and presentation for a virtual adjudication under the SOP Act
- Inter-play between successive adjudication determinations and enforcement actions
- Accounting for proceeds from performance bond calls in payment claims and adjudications
- Pursuing payment claims after termination
- Duty of contract administrator to certify payment claims after project completion or termination
