The seminar will cover the more significant issues in construction law decided in 2024. These include cases which address issues such as the threshold for challenging calls made on performance bonds on the ground of unconscionability, how the election to refer disputes to arbitration affects the right of a beneficiary to receive payment under a performance bond, how the Courts account for concurrent delay and when an employer is deemed to have knowledge of claims against a construction professional for the purposes of ascertaining the applicable limitation period. The impact of these decisions on construction law and practice will also be considered.
The talk will also cover the latest developments in relation to Security of Payment adjudications. It will cover all recent cases. This includes the latest cases relating to the Court’s interpretation of the timing for submission of payment claims, responses and adjudication applications. The implication of these decisions on the preparation of claims will be discussed.
